1. Acceptance of Terms

By downloading, installing, or using Franken-Recipe ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Description of Service

Franken-Recipe is a mobile application that:

• Uses AI to identify ingredients from photos
• Generates creative recipes based on available ingredients
• Provides nutritional information and cooking guidance
• Offers premium features for enhanced functionality

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One account per person; account sharing is not permitted

3.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• We reserve the right to suspend accounts that violate these Terms

4. Acceptable Use

4.1 You Agree To:

• Use the App only for its intended purpose (cooking and recipe generation)
• Provide accurate ingredient information for safety
• Use good judgment when following AI-generated recipes
• Respect other users and our team in any communications

4.2 You Agree NOT To:

• Use the App for any illegal purpose
• Attempt to reverse engineer, hack, or compromise the App
• Upload malicious content, viruses, or harmful code
• Use the App to harass, abuse, or harm others
• Create fake accounts or impersonate others
• Scrape, copy, or redistribute App content without permission
• Circumvent any security features or access restrictions
• Use automated systems or bots to access the App
• Attempt to bypass rate limits or abuse API endpoints
• Share, sell, or transfer your account credentials

4.3 Rate Limits & Fair Use

To ensure fair access and protect our service for all users, we implement rate limiting on API requests:

• Authentication: 5 login attempts per 15 minutes per IP address
• Account Creation: 3 signup attempts per hour per IP address
• Image Analysis: 10 requests per minute per user
• Recipe Generation: 20 requests per minute per user
• Premium Features: 30 requests per minute per user

Exceeding these limits will result in temporary blocking (HTTP 429 status). Repeated or intentional abuse may result in account suspension.

5. AI-Generated Content Disclaimer

5.1 Nutritional Information

Nutritional data provided by the App is estimated and may not be 100% accurate. It should not be used for medical purposes. Consult a registered dietitian for precise nutritional guidance.

5.2 Supplement Recommendations

Any supplement suggestions are informational only and should not replace professional medical advice. Always consult a healthcare provider before starting any supplement regimen.

6. Premium Subscriptions

6.1 Subscription Plans

• Monthly: $4.99/month, billed monthly
• Yearly: $29.99/year, billed annually (50% savings)

6.2 Billing & Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment is charged to your Apple ID or Google Play account upon purchase confirmation
• Your account will be charged for renewal within 24 hours prior to the end of the current period

6.3 Cancellation

• You may cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Premium features remain accessible until the subscription expires

6.4 Refunds

• Refund requests are handled by Apple App Store or Google Play
• We do not process refunds directly
• Contact Apple or Google support for refund inquiries

7. Intellectual Property

7.1 Our Content

The App, including its design, features, code, and content (excluding user-generated content), is owned by Franken-Recipe and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

• You retain ownership of photos you upload
• By uploading photos, you grant us a limited license to process them for ingredient detection
• We do not claim ownership of your saved recipes or personal data

7.3 AI-Generated Recipes

Recipes generated by our AI are provided for personal use. You may share recipes but may not commercially redistribute them or claim them as your own original creations without acknowledgment.

8. Limitation of Liability

• We do not guarantee the accuracy of AI ingredient detection
• We are not responsible for adverse reactions to recipes
• We are not liable for data loss, service interruptions, or technical issues
• Our total liability is limited to the amount you paid for premium subscriptions in the past 12 months
• We are not liable for any indirect, incidental, or consequential damages

9. Indemnification

You agree to indemnify and hold harmless Franken-Recipe, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or upload

10. Termination

10.1 By You

You may stop using the App and delete your account at any time through the app settings.

10.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service or other users
• Fail to pay for premium subscriptions

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@frankenrecipe.app to attempt informal resolution.

11.2 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

11.3 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration, except for claims that may be brought in small claims court.

12. General Provisions

12.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Franken-Recipe.

12.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

12.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

12.4 Assignment

We may assign our rights under these Terms. You may not assign your rights without our written consent.
